Terms of Use (EULA)

Please read these Terms of Use carefully before using Bonsai Nikki. By downloading, installing, or using the application, you agree to be bound by these terms. If you do not agree, do not use the application.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you and BonsaiNikki governing your use of the Bonsai Nikki mobile application and any related services. By accessing or using the app, you confirm that you are at least 13 years old and have the legal capacity to enter into this agreement.

2. Description of the Service

Bonsai Nikki is a bonsai journal application that allows users to track their bonsai trees, log care events, record repottings and health issues, manage an inventory of supplies, and plan future care tasks.

The application is available in two tiers:

Free plan: Limited to 2 active trees, 10 photos per tree, 10 inventory items, and 10 planning tasks.
Premium plan: Unlimited trees, photos, inventory items, and planning tasks, plus early access to new features.

3. Subscription Terms

      Subscription period: Monthly. Your subscription grants access to the Premium plan for one (1) calendar month from the date of purchase.
Price: The price of the subscription is displayed in the App Store or Google Play Store at the time of purchase, in your local currency. Prices may vary by region.
Automatic renewal: Subscriptions automatically renew at the end of each period unless cancelled at least 24 hours before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
Free trial: If a free trial is offered, unused portions of a free trial are forfeited upon purchasing a subscription.
Managing your subscription: On iOS, manage your subscription at Settings → Apple ID → Subscriptions. On Android, manage at Google Play → Subscriptions.

    

4. License Grant

Subject to these Terms, BonsaiNikki grants you a limited, non-exclusive, non-transferable, revocable license to download and use Bonsai Nikki on your personal device solely for your personal, non-commercial purposes.

You may not:

Copy, modify, or distribute the application or its content
Reverse engineer or attempt to extract the source code
Use the application for any unlawful purpose
Sublicense or resell access to the application

5. User Content

You retain ownership of any content you create within the app, including journal entries, photos, and notes. By uploading content, you grant BonsaiNikki a limited license to store and display that content solely for the purpose of providing the service to you. We do not share your personal content with third parties without your consent.

6. Acceptable Use

You agree not to use Bonsai Nikki to:

Upload content that is illegal, harmful, or violates the rights of others
Attempt to gain unauthorized access to the service or its infrastructure
Interfere with or disrupt the integrity of the service
Use automated tools to access or scrape the application

7. Intellectual Property

All content, trademarks, logos, and software associated with Bonsai Nikki are the property of BonsaiNikki or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding.

8. Privacy

Your use of Bonsai Nikki is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the app, you consent to the collection and use of your data as described in the Privacy Policy.

9. Disclaimer of Warranties

Bonsai Nikki is provided "as is" and "as available" without warranties of any kind, express or implied. BonsaiNikki does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the application is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, BonsaiNikki shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the application. Our total liability to you for any claim shall not exceed the amount you paid for the subscription in the three months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your access to Bonsai Nikki at any time, with or without notice, if you violate these Terms. Upon termination, your license to use the application ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

12. Governing Law

These Terms are governed by the laws of Ireland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

13. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will revise the Effective Date at the top of this page. Continued use of the application after changes are posted constitutes your acceptance of the revised Terms.
